Dismissal notice rules (Labor Standards Act, Art. 26)
To dismiss an employee, a company must give at least 30 days' notice. Without notice, or with less than 30 days, it must pay 30 days' ordinary wages or more as dismissal notice pay.
Exceptions (no pay)
- Continuous employment of less than 3 months
- Business can't continue due to unavoidable causes such as natural disasters
- The employee intentionally caused major damage to the business, etc.
Dismissal notice pay ≠ unfair dismissal relief
Receiving notice pay doesn't make a dismissal fair. If you think the reason was unfair, you can apply to the regional Labor Relations Commission for relief from unfair dismissal within 3 months of the dismissal (workplaces with 5+ employees).
